Penalties for First-Time DUI in California
If you are lawfully arrested with a blood alcohol content (BAC) level of .08 or greater, you will likely be charged with at least two criminal offenses: driving under the influence and driving with a .08 percent or higher alcohol content. In general, a conviction for a first-time DUI (or your first DUI within a 10-year period) in California is a misdemeanor.
Assuming there are no aggravated circumstances such as bodily injury or fatalities, a first-time DUI conviction can incur the following penalties:
- Up to $2,300 or more in fines and penalty assessments;
- Up to six months in county jail;
- Community service work;
- Attendance at AA meetings;
- Driver's license suspension for six months, with the possibility of obtaining a restricted license after 30 days;
- Three to nine months of DUI school;
- Three to five years of probation; and
- Installation of an ignition interlock device.
